Residential Facilities

Non-Traditional Residential Facilities

The primary purpose of placement in a residential facility is for the provision of 24/7 treatment and care. Typically, students are either parentally placed in residential facilities or placed by the courts. These programs include Juvenile Detention Facilities, Inpatient Psychiatric Treatment Facilities (sub-acute and acute care), Alcohol and Drug Treatment Facilities, and Intermediate Care Facilities for the Mentally Retarded (ICFMR). Length of stay may vary ranging from 24 hours to multiple years. Approved residential facilities will provide the necessary special education and related services as written in the Individualized Education Program (IEP); however, the public school district where the residential facility is located is ultimately responsible for the procedural safeguards and the provision of a Free Appropriate Public Education (FAPE).

Application for Approval (2017-18)

Pursuant to Ark. Code Ann. § 6-20-107, no state or federal funds may be transferred from the Department of Education, a public school district, or an open-enrollment public charter school, to a residential facility for educational costs or other related costs unless the facility's educational program has been approved by the Arkansas Department of Education (ADE). Therefore, pursuant to Arkansas Code Annotated § 6-41-201 et seq. and 34 CFR Part 300 of the Federal Regulations implementing the Individuals with Disabilities Education Act (IDEA), the ADE, Special Education Unit (SEU), has established an application process for a residential facility to seek approval for its special education program.

Residential Placement Registry

The Arkansas Department of Education (ADE) receives an annual appropriation to reimburse school districts for educational costs for disabled and nondisabled students admitted for short term and long term placement in approved residential alcohol/drug abuse and psychiatric facilities. The Residential Placement Registry Web Application was created to help simplify the processing of reimbursements for the educational costs for disabled and nondisabled students in a residential placement facility.
