Act 1240 established that a school district may petition the State Board of Education to be granted the same waivers that are granted to open-enrollment public charter schools. A school district is eligible to apply for waivers if a student who resides in the school district attends a charter school. The petition shall include the name of the open-enrollment public charter school that draws students from the school district, a copy of the waivers granted to the open-enrollment public charter school and a list of waivers that the school district seeks to have granted.
Section 9101 of Public Law 107-110, Elementary and Secondary Education Act defines a highly qualified teacher as a teacher that “has obtained full State certification as a teacher (including certification obtained through alternative routes to certification) or passed the State teacher licensing examination, and holds a license to teach in such State, except that when used with respect to any teacher teaching in a public charter school, the term means that the teacher meets the requirements set forth in the State's public charter school law” (emphasis added). Therefore, Arkansas non-charter schools must continue to employ licensed teachers in core academic areas to remain in compliance with Federal law. Districts applying for waivers should complete a District Waiver Request Form and email the completed form and the charter waiver list(s) to Kelly.McLaughlin@arkansas.gov
